If the combined value of your real and personal property exceeds $100,000 you may need to consider something more than a simple Will. In California Wills are subject to probate, a legal process that is administered through the Southern California Probate courts. This process determines a will’s validity, resolves any creditor claims of debt and distributes the remaining estate assets to beneficiaries, relatives or heirs.
Probate can be very unpleasant for families suffering with their loss of a loved one. It can also be complicated and take considerable time. Costs related to probate can run as high as 10% or more of an estate’s gross assets. During probate, a basic will can also be contested by anyone and will ultimately become public record. Lengthy probate can be avoided with a trust if properly set up, your assigned heirs may be able to avoid inheritance taxes, and you will have the power to appoint a trustee to handle financial and health related matters in the event you become incapacitated and unable to manage your own finances.
