If the combined value of your real and personal property exceeds $100,000 you may need to consider something more than a simple Will. In California Wills are subject to probate, a legal process that is administered through the Southern California Probate courts. This process determines a will’s validity, resolves any creditor claims of debt and distributes the remaining estate assets to beneficiaries, relatives or heirs.

Probate can be very unpleasant for families suffering with their loss of a loved one. It can also be complicated and take considerable time. Costs related to probate can run as high as 10% or more of an estate’s gross assets. During probate, a basic will can also be contested by anyone and will ultimately become public record. One preferable alternative to a basic will is a Revocable Living Trust. With a Living Trust all or some of your assets can be administered by someone you know and trust, without court involvement and without becoming public record. Lengthy probate can be avoided with a trust if properly set up, your assigned heirs may be able to avoid inheritance taxes, and you will have the power to appoint a trustee to handle financial and health related matters in the event you become incapacitated and unable to manage your own finances.
