What is the cost of probate?

Are you worried about the expense?

Probate is not an easy process, nor is it a cheap one. Our lawyers can provide invaluable counsel to help you decide if probate is the best choice for your situation.

California Statutory Fees for Probate

California Probate Code § 10810 provides the statutory limitations on attorney fees for probate according to the value of the decedent's property. For the first $100,000, the limit is 4% and then drops to 3% for the next $100,000.

The limit for the next $800,000 is 2%, then 1% for the next $9 million, and then finally 0.5% for the next $15 million. For estates larger than $25 million, the limit is determined by the court. These fees can be charged by attorneys and executors individually, meaning that the fees could be double the amounts listed above.

A basic breakdown up to $2 million is shown below:

Estate Value

Attorney Fee Executor Fee
$100,000 $4,000 $4,000
$200,000 $7,000 $7,000
$300,000 $9,000 $9,000
$400,000 $11,000 $11,000
$500,000 $13,000 $13,000
$600,000 $15,000 $15,000
$700,000 $17,000 $17,000
$800,000 $19,000 $19,000
$900,000 $21,000 $21,000
$1,000,000 $23,000 $23,000
$2,000,000 $33,000 $33,000

Additionally, a court filing fee of $435 will be charged for a probate petition, as well as a petition for final distribution. Other fees may apply in some cases, as well. Your best decision at this point would be to speak with a probate lawyer who can provide a qualified evaluation of your case.
