California Statutory Fees for Probate

California Probate Code § 10810 provides the statutory limitations on attorney fees for probate according to the value of the decedent's property. For the first $100,000, the limit is 4% and then drops to 3% for the next $100,000.

The limit for the next $800,000 is 2%, then 1% for the next $9 million, and then finally 0.5% for the next $15 million. For estates larger than $25 million, the limit is determined by the court. These fees can be charged by attorneys and executors individually, meaning that the fees could be double the amounts listed above.

Additionally, court filing fees will be $435 will be charged for a probate petition, as well as a petition for final distribution. Other fees may apply in some cases, as well.
